Legal Aspects of Lifetime Planning

- Does my child have the ability to make important decisions? If not, what legal or other measures can I, as a parent, take to ensure proper protection?
- What is a guardian? How do temporary, limited, or full guardianships work? Is there a difference between guardianship over a person and guardianship over property? Can a guardianship system meet my child’s needs that cannot be met in any other way?
- What are the alternatives to guardianship?
- Do I need a will? What should be included in the will?
- What will happen if I die without a will?
The services are to be planned as a group and are intended to drive toward a result—they should not be haphazard or scattershot activities, but coordinated with each other to achieve that outcome or result. Preparing children with disabilities to “lead productive and independent adult lives, to the maximum extent possible” is one of IDEA’s stated objectives.
