504조항은 장애를 가진 시민의 권리를 보호하는 연방정부 법으로 이 법은 연방 정부의 지원을 받는 모든 기관의 장애로 말미암은 차별을 금지하고 있다. 모든 초등학교와 중, 고등학교 프로그램 및 활동은 504조항을 준수해야 한다.
504조항의 대상은 신체 또는 정신적 손상으로 인해 일상생활에 한 가지 이상의 실제적 제한이 있을 경우 해당된다. 장애의 진단만으로 504조항의 적격성이 학생에게 자동으로 주어지는 것은 아니며 학생이 이 조항에 해당될 것이라는 부모/후견인 또는 교사는 학생의 학교에 504조항 팀 회의를 요청할 수 있다. 팀에는 학교 교직원, 기타 전문가, 학부모/후견인과 함께 해당할 경우, 학생이 포함된다. 팀은 학생의 장애가 교육적 프로그램과 활동에 균등한 기회를 받기 위해 조정이 필요한지를 판단하기 위하여, 장애가 없는 학생들의 수행 능력과 해당 학생의 능력을 비교해야 한다.

비장애 학생과 비교할 고려 대상은 다음과 같을 경우이다:
- 학생이 지속적으로 학과물을 완수하는 데에 보다 많은 시간이 필요한 경우
- 정기적인 학업조정이 필요한 경우
- 교육 프로그램에 눈에 띄게 지장을 주는 행동을 자주 할 경우
- 학생이 스스로 자신을 돌보지 못하여 도움이 필요한 경우
If a person falls into any of these categories, the ADA protects them. Because the ADA is a law, and not a benefit program, you do not need to apply for coverage.
The Americans with Disabilities Act (ADA) also protects the overall rights that individuals with disabilities can enjoy as citizens. It includes provisions to protect against discrimination based on disability in areas such as employment, participation in all programs and services (public education, recreation, healthcare, social services, courts, voting, etc.), use of public transportation, access to public facilities, and communication relay services.

부모의 권리
- 학생의 장애에 따라 일어나는 차별없이 공교육 프로그램에 참여하고 혜택을 받을 수 있는 권리
- 학생의 신분 증명과 평가 그리고/또는 추천되는 편의 제공에 관한 통보를 받을 권리
- 적절한 무상 공립교육을 받을 권리. 이에는 장애가 없는 학생과 함께 최대한 적절한 상황에서의 교육을 받을 권리를 포함한다.
- 학생이 가능한 한 장애가 없는 학생과 동등하게 학교 프로그램과 학교가 후원하는 과외 활동에 참여할 기회를 얻을 권리
- 학생의 교육기록을 살펴보며 이 기록의 복사본을 받을 권리
- 학생을 잘 아는 사람이 제공하는 정보 및 평가자료와 프로그램의 선택 등 다양한 자료를 통해 식별, 평가, 배치/프로그램 결정을 받는 권리
- 식별, 평가, 배치/프로그램 결정에 불만이 있을 경우 문제 해결 방법을 찾을 권리
